Mumbai Drug Bust Case Live Updates: Aryan Khan’s Bail Hearing In Mumbai Court Today

Mumbai sessions court has agreed to hear the bail plea of Bollywood actor Shah Rukh Khan’s son Aryan Khan today after the Narcotics Control Bureau ​(NCB) files its reply.

The court asked the Narcotics Control Bureau to file its reply today morning by 11 am and argue in the same matter in the second half of the day.

A Mumbai Magistrate court had on October 7 sent Aryan Khan and seven others to judicial custody for 14 days.

On October 8, the Esplanade court rejected the bail plea of Aryan Khan, Arbaz Seth Merchant and Munmun Dhamecha, in relation to the drugs seized following an NCB raid at a party on the Cordelia Cruise ship, which was mid-sea and on its way to Goa on October 2 night.

Eight persons including Aryan Khan, Arbaz Seth Merchant, Munmun Dhamecha, Vikrant Chhoker, Ismeet Singh, Nupur Sarika, Gomit Chopra and Mohak Jaswal were arrested on October 3 in connection with the drug seizure on the cruise ship, and were produced before Mumbai’s Esplanade Court on October 4.

They were remanded to NCB custody till October 7, which is when the Mumbai Magistrate court sent them to judicial custody for 14 days.

Mumbai Drugs-On-Cruise Case: Aryan Khan, Others Inextricably Connected: Narcotics Control Bureau’s No Bail Argument
Aryan Khan and all other accused in the drugs-on-cruise case are connected and their roles cannot be separated, the Narcotics Control Bureau (NCB) says in its reply to a court that will decide on the bail request of Shah Rukh Khan’s son.

“The ingredients of conspiracy are clear and evident,” says its reply to the court, adding that “one of the applicants cannot be considered in isolation”.

No drugs were found on Aryan Khan when the anti-drugs agency’s officers raided a Mumbai cruise ship party in disguise on October 3. But the NCB says that does not undermine their role.

Court Update |  The NCB reply states:

The material collected during the investigation has primarily revealed that Accused No 1 (Aryan Khan) has role in so far as illicit procurement and distribution of contraband is concerned. 

It is prima facie revealed that Aryan Khan used to procure contraband from Accused No 2 (Arbaaz Merchant). And sources connected to Accused No 2 from whose conscious possession (shoes) 6 grams of charas was recovered. Aryan and Arbaaz have been associated in close collaboration.

Thus, it is so far apparent that Accused No 17 and 19 supplied charas/ganja to Accused No 1 and 2.

The investigations have further revealed that Accused No 3 (Munmun Dhamecha) was arrested with 5 grams of hashish from her

conscious possession. She was intercepted with such quantity of contraband from the said Cruise. Thus, as she was arrested with contraband from the said Cruise her culpable mental state is clear and evident.

Court Update | While replies have been submitted, the hearing has not started yet. Additional Solicitor General Anil Singh and Special Public Prosecutor Advait Sethna, representing the Narcotics Control Bureau, have not reached the court yet.

Court Update | Narcotics Control Bureau lawyers have submitted their reply to the counsel of the accused. In their reply, the NCB says that all the accused in this case are connected so its not possible to dissect their roles from each other.

Court Update | The Narcotics Control Bureau’s counsel has said that they will file a reply in a while. 

Additional Solicitor General (ASG) Anil Singh will also appear on behalf of the NCB in the hearing but he is currently occupied with a hearing at the High Court. Special Public Prosecutors AM Chimalker and Advait Sethna are appearing for the NCB as well.

BJP leader Mohit Bharatiya bites back at NCP leader and spokesperson Nawab Malik in a tweet, after Mr Malik pointed fingers at Mr Bharatiya on Saturday in relation to the Mumbai drugs-on-cruise case. 

Mr Malik had claimed that the Narcotics Control Bureau had initially detained 11 people total from the Goa-bound cruise ship off Mumbai coast last week, but then let off three of them, including the brother-in-law of BJP leader Mohit Bharatiya, a couple of hours later.

Court Update | Counsel Amit Desai is also present along with Satish Maneshinde’s team for Aryan Khan, as is Shah Rukh Khan’s manager Pooja Dadlani.

The court is currently awaiting the Narcotics Control Bureau’s written reply.

After being denied bail twice since his arrest over a week ago in the drugs-on-cruise case, Aryan Khan’s third bail plea did not get heard on Monday, as the Narcotics Control Bureau (NCB) insisted they were not ready with their statement for the Mumbai sessions court. Aryan Khan’s bail request will be heard today after the NCB files its reply to the court.
